Terms of services

Business relations between the Agency and a physical or legal person (hereinafter: the Client) signing a Brokerage Contract with the Agency shall be governed by the General Operating Conditions. The Agency is an authorized company that meets the requirements for providing brokerage services in real estat and is entered in the Register of Real Estate Agents at the Croatian Chamber of the Economy. The real estate agents employed in the Agency are entered in the Directory of Real Estate Agents at the Croatian Chamber of the Economy.

 

BROKERAGE FOR LEASING

When a Lessor instructs the Agency to act as a broker in the lease of real estate, or when the Lessee instructs the Agency to connect him with a person to negotiate with him regarding a lease, or when the Lessee instructs the Agency to mediate in finding suitable real estate to lease, the Agency will sign with the Client a brokerage contract/order.

The Agency shall be obliged to verify ownership of the real estate which is the subject of the lease, to organize a presentation of the real estate, to carry out negotiations necessary for reaching an agreement on the lease of the real estate, to broker the Lease Agreement, and to attend the handover of the real estate, on which occasion handover protocol shall be implemented.

 

BROKERAGE FEE FOR A LEASE

The amount of the brokerage fee shall be determined pursuant to the Price List of the Croatian Chamber of the Economy. The agency fee shall be paid when signing the Lease Agreement.

 

LEASING OUT - Commission from the Lessor:

For a lease of 1 to 5 years: 100% of one monthly rent + VAT

For a lease of 5 years or more: 150% of one monthly rent + VAT

The said fee shall represent half the total commission. The other half shall be collected from the Lessee of the real estate.

 

TAKING ON A LEASE - Commission from the Lessee:

For a lease of 1 to 5 years: 100% of one monthly rent + VAT

For a lease of 5 years or more: 150% of one monthly rent + VAT

The said fee shall represent half the total commission. The other half shall be collected from the Lessor of the real estate.

 

BROKERAGE FOR A VENDOR

When the Vendor instructs Best Croatian Properties d.o.o. to act as broker in the sale of real estate, the Agency will sign a brokerage contract/order with the Vendor. By signing the real estate brokerage contract, the Agency commits to carry out the following for the Vendor (Client), in particular:

  • Try to find and connect the Client with a person with whom the brokered deal will be signed
  • Inform the Client about the average market price of similar real estate
  • Examine the documents proving ownership or other proprietary rights over the real estate and warn the Client of obvious defects and possible risks in connection with the disorderly condition of the land-registry status of the real estate; registered proprietary rights or other rights of third parties to the real estate; legal consequences of failing to meet obligations to third parties; shortcomings of the building permit and inspection certificate under special law; and details of the mandatory application of pre-emption rights and limitations in legal transactions under special regulations.
  • Take necessary actions in order to present the real estate on the market; advertise the real estate in a proper manner, and carry out any other actions agreed in the real estate brokerage contract that exceed normal presentation, for which the Agency shall be entitled to reimbursement for special expenses, announced in advance.
  • Enable examination of the real estate.
  • Mediate in negotiations and invest efforts to facilitate the signing of the contract.
  • If the real estate in question is land property, verify the uses to which the land property may be put under the applicable physical planning rules .

 

BROKERAGE FEE FROM THE VENDOR

The amount of the brokerage fee shall be determined pursuant to the Price List of the Croatian Chamber of the Economy. The Agency fee shall be paid when signing the Preliminary Sales Contract.

For brokerage services provided in the sale of real estate, the Vendor shall pay to the Agency commission in the amount of 2% of the agreed sale price + VAT. This fee shall represent one half of the total commission, while the other half shall be collected from the buyer of the real estate.

The Agency retains the right to alter the amount of the brokerage fee, which shall be specified in the brokerage contract. The amount of the total fee shall not exceed 6% of the sale price of the real estate + VAT.

 

BROKERAGE FOR THE BUYER

When the Buyer instructs the Agency to connect him with the Vendor of real estate or when the Buyer instructs the Agency to mediate in the purchase of real estate, the Agency shall sign a brokerage contract/order with the Buyer. By signing the real estate brokerage contract/order, the Agency commits to carry out the following for the Buyer (Client), in particular:

  • Disclose to the Buyer proof of ownership of the real estate being sold.
  • Organize verification of the signatures on the preliminary sales contract or sales contract by a notary public.
  • In the case of partial or full payment of the sale price by means of a bank loan, attend the solemnization of the loan agreement in a notary public's office, after which the request for registration of the mortgage shall be submitted to the Land Registry Department of the competent court, so that the mortgage can be registered.
  • After the mortgage is registered, deliver to the Buyer the registration certificate and land registry certificate with the mortgage duly entered.
  • Attend payment of the sale price and handover of the real estate, on which occasion a handover protocol shall be implemented.
  • Inform the Buyer of the mandatory payment of capital transfer tax or of the conditions for exemption from capital transfer tax.

 

BROKERAGE FEE FROM THE BUYER

The amount of the brokerage fee shall be determined pursuant to the Price List of the Croatian Chamber of Commerce. The agency fee shall be paid when signing the Preliminary Sales Contract.

For brokerage services provided during purchase of real estate, the Vendor shall pay to the Agency commission in the amount of 3% of the agreed sale price of the real estate + VAT. This fee shall represent one half of the total commission, while the other half shall be collected from the Vendor of the real estate.

The Agency retains the right to change the amount of the brokerage fee, which shall be specified in the brokerage contract. The amount of the total fee shall not exceed 6% of the sale price of the real estate + VAT.
